Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and JR Strength and Fitness LLC, doing business as Built For Her ("Built For Her," "we," "us," or "our") governing your access to and use of Built For Her websites, applications, subscriptions, coaching services, community features, educational materials, communications, and related products and services (collectively, the "Platform").

By creating an account, selecting a subscription, clicking an acceptance control presented with these Terms, or otherwise taking an action that the Platform identifies as acceptance, you agree to these Terms. If you do not agree, do not create an account, purchase a subscription, or use the Platform.

The Privacy Policy describes our data practices. The Medical, Fitness & Nutrition Disclaimer, Fitness Participation, Assumption of Risk & Release, Community Guidelines, Acceptable Use Policy, and Copyright & Intellectual Property Policy are incorporated into these Terms to the extent stated in those documents. Where separate consent or acknowledgment is required, incorporation does not replace that separate consent.

You must be at least 18 years old and legally capable of entering into a binding contract to create an account or use the Platform. The Platform is offered for use in the United States. You may not use the Platform if doing so would violate applicable law or if we have suspended or terminated your access.

Built For Her does not knowingly offer accounts to children or minors. If we learn that an account holder is under 18, we may suspend or close the account and take appropriate steps concerning associated data.

You agree to provide accurate, current information, keep your credentials confidential, use only your own account, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account to the extent permitted by law. You may not sell, transfer, share, or permit another person to use your account.

We may require identity or account verification when reasonably necessary to protect members, the Platform, or legal rights.

Built For Her provides fitness programming, workout tracking, progress tools, fitness nutrition coaching and education, educational content, community features, and, depending on the subscription selected, human coaching and related services. Features and access vary by subscription tier and may change over time.

Descriptions shown at checkout or in the Platform form part of the applicable offer. We may add, modify, replace, or discontinue features, provided that we will not knowingly misrepresent a paid subscription's material terms and will provide notice when required by law.

Built For Her does not guarantee any particular strength, physique, weight, health, performance, adherence, or other result.

Built For Her is a fitness and wellness service, not a medical practice. Coaching is fitness, strength, behavior, lifestyle, and general nutrition coaching within the coach's lawful scope. Coaching does not include diagnosis, treatment, physical therapy, psychotherapy, medical nutrition therapy, or treatment of metabolic or other disease.

Online coaching is not continuous supervision. You are responsible for determining whether your environment, equipment, exercise selection, loading, and execution are safe at the time you train, and for stopping when conditions or symptoms make continued activity unsafe.

Coaches may rely on information you provide. You agree to provide materially accurate information relevant to safe participation and to update it when circumstances materially change.

Paid subscriptions are billed monthly unless a checkout page expressly states otherwise. The price, applicable taxes, trial terms, billing frequency, and material subscription terms will be displayed before you enroll.

By enrolling in a paid subscription or a free trial that converts to a paid subscription, you authorize Built For Her and its payment processor to charge the payment method you provide for recurring monthly subscription charges and applicable taxes until you cancel.

Subscription access is personal and non-transferable.

When a 7-day free trial is offered, the checkout flow will disclose the trial duration, the date or method for determining when the first charge will occur, the price that will apply after the trial, the recurring billing frequency, and how to cancel.

Unless you cancel before the free trial ends, the trial will automatically convert to the monthly paid subscription you selected and your payment method will be charged the disclosed subscription price plus applicable taxes. The subscription will then continue to renew monthly until cancelled.

Eligibility for a free trial may be limited to new members or one trial per person, household, payment method, or other reasonable criteria disclosed with the offer. We may prevent abuse of promotional offers.

You may cancel your subscription at any time through the cancellation method made available in your account or billing portal. We will not require a telephone call or live conversation to cancel an online subscription unless permitted by applicable law and an equally simple online method remains available.

For a paid subscription, cancellation prevents the next renewal charge and ordinarily takes effect at the end of the then-current paid billing period. You may continue using paid features through that period unless your account is terminated for cause.

For a free trial, cancellation before the trial converts to paid service prevents the recurring paid subscription from beginning, subject to the timing disclosed at enrollment.

We will provide cancellation confirmation in a durable form when required by law or as part of our standard process.

Except where required by applicable law, subscription charges are nonrefundable after they are charged, and we do not provide prorated refunds or credits for partially used billing periods, unused services, missed workouts, or failure to use the Platform. Built For Her may issue a refund or credit in its discretion without creating an obligation to do so in other cases.

Nothing in this section limits non-waivable cancellation, refund, rescission, or consumer rights provided by applicable law.

Prices may change. If we increase the recurring price of an existing subscription, we will provide advance notice and obtain any consent required by applicable law before the increased price applies to a future renewal.

You are responsible for applicable taxes unless the law requires us to collect them. If a payment fails, we or our payment processor may retry the charge, request an updated payment method, limit paid access, or suspend the subscription, subject to applicable law. You remain responsible for valid charges incurred before cancellation or termination.

Payments are processed by Stripe or another disclosed payment processor. Built For Her does not intend to store full payment card numbers. Payment processors may process information under their own terms and privacy notices. You authorize us to transmit information necessary to process authorized transactions and manage your subscription.

The Platform is not medical advice and is not a substitute for evaluation or care from a qualified healthcare professional. You should seek appropriate professional guidance before beginning or materially changing an exercise or nutrition program when your circumstances warrant it, including if you have an injury, medical condition, concerning symptoms, are pregnant or postpartum, take medications affecting exercise or nutrition, or have a history of disordered eating.

You must review and acknowledge the Medical, Fitness & Nutrition Disclaimer and Fitness Participation, Assumption of Risk & Release presented by the Platform.

The Platform may use automated systems and artificial intelligence to analyze information, generate or summarize content, support coaches, personalize training or education, suggest substitutions or progressions, adjust recommendations, answer questions, or assist with administrative tasks.

AI-generated or AI-assisted output may be incomplete, inaccurate, or inappropriate for your circumstances. AI is not a physician, dietitian, physical therapist, mental-health professional, or emergency service. Do not rely on AI output to diagnose, treat, or make urgent health decisions.

Some AI functions may require information from your account to be processed by third-party AI service providers. Our Privacy Policy describes applicable processing and providers or categories of providers. We will not intentionally represent an automated output as having been personally reviewed by a human when it has not.

Built For Her may change, limit, suspend, or require human review for AI features as appropriate for safety, quality, privacy, or legal compliance.

  • Use reasonable judgment and train within your current abilities.
  • Use safe, properly maintained equipment and a suitable environment.
  • Follow equipment instructions and applicable facility rules.
  • Stop exercise and seek appropriate care if you experience concerning symptoms, injury, or a material change in health.
  • Do not intentionally provide false readiness, injury, health, or training information that could make recommendations unsafe.
  • Do not use the Platform while impaired or in circumstances where exercise would be unsafe.

Community and messaging features are governed by the Community Guidelines. We may moderate or remove content and may restrict community privileges when reasonably necessary to enforce these Terms, protect users, or comply with law.

Transactional communications concerning your account, security, subscription, coaching, or service may be sent by email or push notification as reasonably necessary to provide the Platform. Marketing email is subject to applicable law and available unsubscribe controls. Built For Her does not currently use SMS for member communications.

16. User Content

You retain ownership of original content you submit, including messages, posts, check-ins, comments, and uploaded media, subject to rights held by others.

You grant Built For Her a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process your User Content only as reasonably necessary to operate, secure, improve, support, and provide the Platform; comply with law; enforce these Terms; and exercise other uses to which you separately consent.

This operational license does not give Built For Her permission to use your progress photos, likeness, testimonial, transformation story, or private coaching content in advertising or public marketing. Marketing use requires separate authorization where applicable.

You represent that you have the rights necessary to submit your User Content and that doing so does not unlawfully violate another person's rights.

Progress photographs are intended to be private member data unless you affirmatively choose to share them through a feature designed for sharing. Authorized coaches and personnel may access them only as necessary to provide services, support the account, maintain security, or as otherwise disclosed in the Privacy Policy.

Built For Her will not use a member's progress photographs for advertising, social media, testimonials, before-and-after marketing, or other promotional use without a separate affirmative release or authorization.

The Platform and its content, including software, branding, Training Systems, Blueprints, program structures, workouts, progression frameworks, Academy materials, Standards, written coaching content, exercise media, graphics, and other materials, are owned by Built For Her or its licensors and are protected by applicable intellectual-property laws.

While your subscription is active, Built For Her grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform and member-facing content for your personal, noncommercial fitness and educational use.

Except as permitted by law or written authorization, you may not reproduce, distribute, publish, sell, sublicense, scrape, systematically download, reverse engineer, create a competing content library from, or commercially exploit protected Platform content.

You must comply with the Acceptable Use Policy. Prohibited conduct includes unauthorized access, credential sharing, scraping, security circumvention, malware, harassment, unlawful content, infringement, impersonation, and commercial redistribution of Platform content.

The Platform depends on third-party providers for functions such as hosting, databases, authentication, payments, email, push notifications, AI, storage, and other infrastructure. Those services may experience outages or changes outside our control.

Wearable and health-platform integrations are planned but are not currently represented as live features. If integrations are added, additional terms, permissions, disclosures, or consents may apply.

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and how applicable privacy choices may be exercised. Where law requires consent for particular processing, we will seek that consent separately from general acceptance of these Terms.

We work to provide a reliable Platform but do not guarantee uninterrupted or error-free availability. Maintenance, security events, provider outages, technical failures, legal requirements, or product changes may temporarily or permanently affect features.

We may update or discontinue features. If a change materially affects a paid subscription in a manner that triggers notice, cancellation, refund, or other rights under applicable law, those rights will apply.

We may suspend or terminate access for material breach of these Terms, nonpayment, fraud, abuse, security risk, unlawful conduct, danger to others, infringement, or conduct that materially threatens the Platform or community. When reasonable and legally appropriate, we may provide notice or an opportunity to cure.

You may stop using the Platform at any time and may cancel recurring billing as described above. Account deletion and subscription cancellation are separate actions unless the Platform expressly states otherwise.

Provisions that by their nature should survive termination - including intellectual property, accrued payment obligations, disclaimers, risk allocation, dispute provisions, and lawful data-retention obligations - survive to the extent enforceable.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." BUILT FOR HER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR EVERY PERSON OR CONDITION.

Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILT FOR HER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, COACHES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF BUILT FOR HER ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BUILT FOR HER DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

To the extent permitted by law, you agree to indemnify and hold harmless Built For Her and its owners, personnel, coaches, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Platform, infringement of another person's rights through content you submit, or material violation of these Terms. This provision does not require you to indemnify a party for liability that applicable law prohibits shifting to you.

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except to the extent mandatory consumer law in your state of residence applies.

Unless counsel recommends and Built For Her adopts a valid consumer arbitration agreement, disputes that are not eligible for small claims court will be brought in a state or federal court with jurisdiction over Multnomah County, Oregon, subject to any non-waivable venue rights under applicable law.

We may update these Terms. We will identify the version and effective date. For material changes, we will provide notice as required by law and will request renewed acceptance when legally required or when we determine renewed acceptance is appropriate. Changes do not retroactively alter rights or obligations where prohibited by law.

You consent to receive agreements, notices, disclosures, receipts, subscription communications, and other records electronically, including through the Platform and by email, to the extent permitted by law. You may retain electronic copies. If applicable law requires a specific hardware/software disclosure, withdrawal mechanism, or non-electronic alternative, those requirements will control.

If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect, unless applicable law requires otherwise. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, reorganization, sale of assets, or similar transaction, subject to applicable law. These Terms and incorporated documents constitute the agreement concerning the Platform except for separate written agreements that expressly control a specific service.
